KeyProvisions
Manufactureandbusinessentitiesshallbequalifiedwiththeconditionsforworksafetyasspecifiedbytheprovisionsinlaws,administrativeregulationsandcompulsivestandards.Manufactureandbusinessentitiesthatdonothavesuchconditionsarenotallowedengaginginmanufactureandbusinessactivities.
Manufactureandbusinessentitiesshallcomplywiththefollowingstipulationsonworksafety:
(1Theworkingplaces,equipmentsandfacilitiesshallmeasureuptotherequirementsforworksafety;
(2Formulatingrulesandoperationregulationsforworksafety;
(3Guaranteeinganecessarycapitalinputintoworksafety;
(4Providingworkprotectionproductsthatmeasureuptonationalstandardsorindustrialstandards;
(5Settingupsectionsorbeingmannedwithfull-timepersonsforthecontrolofworksafety;
(6Principalleadingmembersandpersonsforthecontrolofworksafetyshalltakeinthetrainingcourseinworksafetyandpassthequalificationexamination;
(7Qualifiedemployeesshalltakeeducationandtrainingcourseinworksafety,employeesworkingatspecialpostsshallobtainthequalificationcertificateforworkingatspecialpoststhroughreceivingspecialtraininginsafeoperation;TheprincipalleadingmembersofmanufactureandbusinessentitiesshallperformtheresponsibilitiesstipulatedinLawofPeople’sRepublicofChinaonWorkSafetytostudythemattersconcerningworksafetyonaregularbasis,tosubmitreportstoworkersrepresentativemeetingandshareholdersmeetingaboutthesituationaboutworksafety,toacceptthesupervisionandinspectionfromtheworksafetysupervisiondepartmentsandotherdepartmentsconcerned,toacceptthedemocraticsupervisionfromlaborunionandemployees.

PrincipalKeyProvisions
Theleadingmembersinchargeofworksafetyinmanufactureandbusinessentitiesshallassisttheprincipalleadingmemberstoperformtheirresponsibilitiesonworksafety.

Article12Theadministrativesectionsandpersonsresponsiblefor
worksafetyinmanufactureandbusinessentitiesarechargedwiththefollowingresponsibilitiesforworksafety:

(1Carryingoutthelaws,administrativeregulationsandstandardsaboutworksafetyissuedbythegovernment;
(2Assistingtoformulatingtherulesandtechniqueoperationregulationsandproceduresforworksafety;(3Carryingonworksafetyinspection,findoutthehiddendangersthreateningworksafetyandurgetheoperationdepartmentsconcernedtoeliminateandimproveimmediately;
(4Publicizingtheworksafetythrougheducationandtraining,summarizingandpromotingtheexperiencesonworksafety;
(5Participatingintheexaminationandinspectiononthesafetyfacilitiesfortheprojectstobebuilt,renovatedorexpanded,managinganddistributingtheworkprotectionproducts;
(6Assistingtoinvestigateandsettletheaccidentsduetolackofworksafety,submittingthereportonaccidentscasualtybystatisticsandanalysis.
(7Responsibleforotherworksconcerningworksafety.

Article13Manufactureandbusinessentitiesshallsetuprulesand
regulationsabouttheresponsibilitiesonwordsafety,inspection,educationandtraining,awardsandpunishment,safetycontrolonequipmentsandfacilities,distributionandadministrationonworkprotectionproducts,safetycontrolondangerousoperationandspecialoperation,settlementonaccidentsreports.

Article14Industrieswithhigh-leveldangersuchasconstructionand
dangerousproducts(hereinafterreferredtoasindustrieswithhigh-leveldanger,industrieswithpotentiallymoredangersuchasmetalsmelt,shipbuildandrepair,

electricitypowerandgoodsloadingandunloading(hereinafterreferredtoasindustrieswithpotentialmoredanger,andthemanufactureandbusinessentitieswherethenumberofemployeesexceeding300,shallsetupworksafetycommittee;themanufactureandbusinessentitieswherethenumberofemployeesbelow300maysetupworksafetycommittee.

Theworksafetycommitteeinamanufactureandbusinessentityshallbeconstitutedbytheprincipalleadingmembers,theleadingmembersinchargeofworksafety,worksafetycontrolsectionandtheirleadingmembers,personsforworksafetycontrol,representativesfromlaborunionandemployeesofitsownentity.
Worksafetycommitteeisresponsiblefortheexaminationandinspectionofannualplanandimplementationonworksafety,ofmaterialtechnologyprojectsonworksafety,ofkindsofinputsintoworksafetyinitsownentity,fortheunderstandingandinspectiononthematerialmattersforworksafety,fortheurgeonthemeasuresoneliminatingthehiddendangersthreateningtheworksafety.Worksafetycommitteeshallconvenemeetingsatleastonceforhalfayear.Thewrittenminutesshallbekeptforthemeeting.


Article15Fundsforinputessentialtomeetingtheconditionsfor
worksafetyshallbeguaranteedbythedecision-makingsections,principalleadingmembersofmanufactureandbusinessentitiesorprivateinvestors.Thefundsforworksafetyshallbetakenintotheannualplanforproductionandbusinessandfinancialbudget.
Fundsforworksafetyshallbeinputtedintotechnology
projects,equipmentsandfacilitiesonworksafety,publicizing,education,training,andawardsonworksafety,workprotectionproducts,newtechniques,technologiesandmaterialsonworksafety,thesupervisiononsourcesofgrievousdanger,storageofemergencyrescuefacilitiesandmaterialsandothermattersconcerningworksafety.Fundsforworksafetyshallnotbepeculatedforotherpurposes.

Article16Unlessotherwisestipulatedbylawsandadministrative
regulations,manufactureandbusinessentitiesintheindustrywithhigh-leveldanger,wherethenumberofemployeesisbelow300,shallbemannedwithatleastonefull-timepersonforthecontrolofworksafety;wherethenumberexceeds300,theentitiesshallbemannedwithatleastthreefull-timepersonsforthepurpose;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleasteightfull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleastfifteenpersonsforthepurpose.
Manufactureandbusinessentitiesintheindustrywith
potentialmoredanger,wherethenumberofemployeesexceeds300,theentitiesshallbemannedwithatleasttwofull-timepersonsforthecontrolofworksafety;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleastfivefull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleasttenpersonsforthepurpose.
Themanufactureandbusinessentitiesotherthanthe
aforesaidentitiesstipulatedintheabovetwoparagraphs,wherethenumberofemployeesexceeds300,theentitiesshallbemannedwithatleastonefull-timepersonsforthecontrolofworksafety;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleasttwofull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleastfivepersonsforthepurpose.

Article17Principalleadingmembersandleadingmembersin
chargeofworksafetyinthemanufactureandbusinessentitiesforconstructionanddangerousproductsshallbeonlyappointedtothepostsaftertakingthetrainingcourseonworksafetyandpassingtheexaminations;Principalleadingmembersandleadingmembersinchargeofworksafetyinothermanufactureandbusinessentitiesshallparticipateinthetrainingcourseonworksafetyandpasstheexaminationwith3monthsafterbeingappointedtotheposts.

KeyProvisions
Personsforcontrolofworksafetyshallparticipateinthetrainingcourseonworksafetyandpasstheexaminationbeforeholdingtheposts.

Article18Duringtheproductionandbusinessactivities,employees
shallenjoythefollowingrights:

(1Thecollectivecontactsandlaborcontractsshallbeclearlyindicatedthetermsconcerningguaranteesforoccupationalsafety,preventionofoccupationalhazards,aswellasthepaymentofinsurancepremiumsforindustrialinjuriessufferedbyemployees;(2Havingtheknowledgeofthedangerousfactorsexistingattheirworkplacesandposts,andoftheprecautionandexigencymeasures,obtainingtheworkprotectionproductscomplyingwiththenationalstandardsorindustrialstandards;
(3Tosuggest,criticize,informagainstandaccusetheirentitiesoftheproblemsexistinginworksafety;
(4Refusingcomplywiththedirectionsthatarecontrarytorulesandregulationsorarbitraryordersforriskyoperations.Onspottingemergencysituationsthatdirectlythreatentheirpersonalsafety,suspendingoperationorevacuatingfromtheworkplaceaftertakingpossibleemergencymeasures;
(5Demandingcompensationafterbeingdamagedbytheaccidentsduetothelackofworksafety;
(6Otherrightsstipulatedbylawsandadministrativeregulations.

Duringtheproductionandbusinessactivities,employeesshallperformthefollowingduties:
(1Strictlyabidingbyworksafetyrulesandregulations
andoperationinstructionsoftheentitiestheywork;(2Receivingeducationandtraininginworksafety;
(3Reportingthehiddendangersthatmayleadto
accidentsandotherfactorsthatmayjeopardizesafetywithoutdelay;
(4Otherdutiesstipulatedbylawsandadministrative
regulations.

Manufactureandbusinessentitiesshallnotrefusethe
reasonablerequirementsbytheemployees.Worksafetysupervisiondepartments,departmentsconcernedandlaborunionsshallguaranteethelegalrightsandinterestsonworksafetyenjoyedbytheemployees,refrainthemanufactureandbusinessentitiesfrominfringingthelegalrightsandinterestsonworksafetyenjoyedbytheemployees.

Article19Manufactureandbusinessentitiesshallcarryout
educationandtrainingonworksafetyforthefollowingemployeeswithoutdelay”

(1Newemployees;
(2Employeesleavingthepostsover6monthsorforpostsexchange.
(3Employeesatthepoststhatarecarriedoutwithnewtechniques,technologiesandmaterials.

Manufactureandbusinessentitiesshallconductregular
educationandtrainingonworksafetyforallemployeesonposts.

Noemployeeswhofailtopassthequalificationtestsafter
receivingeducationandtraininginworksafetymaybeassignedtoposts.

Article20Thescheduleforeducationandtraininginworksafety
shallcomplywiththerelatedregulationsbythenationalgovernmentandShanghaigovernment.Theexpensesshallbebornebythemanufactureandbusinessentities.
Manufactureandbusinessentitiesmayauthorizethe
agenciesonworksafetytrainingserviceorrelatedindustryassociationstomakearrangementfortheeducationandtraininginworksafety.

Article21Thecontentsfortheeducationandtraininginworksafety
shallincludethelaws,administrativeregulationsandrulesonworksafety,basicskillsonsafetyoperationandbasicknowledgeonsafetytechnology,dangerousfactors

existinginworkplacesandposts,precautionmeasuresandaccidentsemergencymeasures,thefunctionsanduseofworkprotectionproducts,andotherknowledgeonworksafetyneededtounderstand.

Thecontentsforeducationandtraininginworksafetyshallbewrittenintotherecordcardforworksafetybytheemployees.Therecordcardshallbesignedbytheexaminerandemployeehimself.

Article22Manufactureandbusinessentitiesfordangerous
chemicalproducts,civilblastingequipmentsandconstructionshallapplyforworksafetypermittotheauthorityconcernedbeforecarryingouttheproductioninaccordancewithStatuteonWorkSafetyPermit.

Article23Thesecurityofthebuildings,equipmentsandfacilities
temporarilysetupbythemanufactureandbusinessentitiesforthelarge-scalepublicactivitiesshallbeinspectedbytheprofessionallyrecognizedinspectioninstitutesforqualification.

Article24Withthesubmissionofthedesignsofthesafetyfacilities
ofconstructionprojectsforthemanufactureandstorageofdangerousproductstoworksafetysupervisiondepartmentsandrelateddepartmentsforexamination,thesafetyconditionassessmentandreasoningreportsissuedbytheagencieswithprofessionalqualificationonworksafetyassessmentshallbesubmittedaswell.Theexaminationdepartmentshallberesponsiblefortheresultofexamination.
Beforethecompletedconstructionprojectsforthe
manufactureandstorageofdangerousproductsareputintooperationoruse,thesafetyfacilitiesshallundergocheckforacceptancebytheworksafetysupervisiondepartmentsandrelateddepartments.Thesaidprojectsshallonlybeputintooperationoruseafterthefacilitiesarecheckedandaccepted.

Article25Manufactureandbusinessentitiesforthemanufacture,
storageanduseofvirulentchemicalproductsshall,with

thetermstipulatedbythenationalgovernment,authorizetheagencieswithprofessionalqualificationonworksafetyassessmenttoevaluatethesafetyoftheequipmentsformanufactureandstorage,andissuedthesafetyassessmentreport.

Thesafetyassessmentreportshallprovidecorrespondingplanonsafetyreformmeasuresaimingattherealdangerandproblemsexistinginthemanufactureandstorageequipments.
Manufactureandbusinessentitiesshallsubmitthesafetyassessmentreporttotheworksafetysupervisiondepartmentsfortherecordwithoutdelay.


Article26Manufactureandbusinessentitiesshalltakethefollowing
controlmeasuresonthesourcesofgrievousdanger:

(1Settinguptherecordskeptonfileforall-aspectcontrolontheoperationsituation;
(2Conductingregularmonitoringandinspectionontheequipmentsandfacilities;
(3Conductingregularassessmentonsafety;
(4Conductingregularinspectiononthesafetyofthesourcesofgrievousdanger;
(5Makingexigencyrescueplansandorganizingregularmaneuversonexigencyrescue.

Manufactureandbusinessentitiesmayauthorizethe
agencieswithprofessionalqualificationonwordsafetyassessmenttoinspectandassessonthesourcesofgrievousdangerandsuggestthemeasurestoimprovethesupervisiononit.
Manufactureandbusinessentitiesshallreportatleast
onceforahalf-yeartotheworksafetysupervisiondepartmentsandpublicsafetyauthoritiesabouttheimplementationprocedureofthesupervisiononthesourcesofgrievousdanger.

Article27Whencarryingoutdangerousoperationssuchasblasting
andhoistingoflarge-sizedfacilities(components,

manufactureandbusinessentitiesshallsendpersontothesitesspeciallyassignedtogiveoveralldirection.Thesitesshallbeinspectedandsupervisedbythespeciallyassignedpersonsforworksafetysupervision.Suchdangerousoperationsshallbecarriedoutbytheentitieswithprofessionalqualification.Ifauthorizingotherentitieswithprofessionalqualificationforconstruction,manufactureandbusinessentitiesshallenterintotheworksafetycontrolagreementwiththeconstructor.Worksafetycontrolagreementshallspecifyrespectiveresponsibilitiesonworksafetyoftheparties.

Manufactureandbusinessentitiesorauthorizedconstructorsshallmaketheconstructionplanandworksafetyprecautionmeasuresforthedangerousoperationsofblastingandhoistingoflarge-sizedfacilities(components,andsetupthesafetyareainthesites.Whencarryingoutthedangerousoperationssuchasblastingandhoistingoflarge-sizedfacilities(components,employeesshallobservetheoveralldirectionsandcontrolatsites,strictlycomplywiththeoperationplan,operationrulesandproceduresandworksafetyprecautionmeasures.


Article28Ifthepremisesandworkplacesarerentedouttoother
entitiesformanufactureandbusinessactivities,thepremisesandworkplacesrentedshallpossessthebasicconditionsforworksafety.Thepartiesshallenterintoworksafetycontrolagreement.
Lessorsshallexaminethemanufactureandbusiness
scopeofthelessee;conductoverallcoordinationandmanagementamongmorethanonelesseewithinoneworkplaceinrespectofworksafety.Whendiscoveringtheillegalactivitiesonworksafetybythelessees,manufactureandbusinessentitiesshallpreventsuchactivitieswithoutdelayandnotifythelocalworksafetysupervisiondepartmentsandrelateddepartments.
Lesseesshallstrictlycomplywiththelawsand
administrativeregulationsconcerningworksafetyand

possessthenecessaryqualifications,observetheoverallcoordinationandmanagementinrespectofworksafetybylessors.Whenaccidentsduetoneglectofworksafetyoccur,lesseesshalltruthfullyinformthelocalworksafetysupervisiondepartmentsandrelateddepartments.

Article29Manufactureandbusinessentitiesshallprovidetheir
employeeswithworkprotectionproductsthatmeasureuptonationalstandardsorindustrialspecifications,andtheyshallgiveinstructiontotheiremployeesandcheckthattheemployeeswearorusetheseproductscorrectlyinaccordancewiththerulesforuse.Manufactureandbusinessentitiesshallnotsubstitutecashorotherarticlesfortheworkprotectionproducts.Whenpurchasingtheworkprotectionproducts,manufactureandbusinessentitiesshallrequiretheproductexaminationcertificatefortherecordkeptonfile.

Article30Personsofmanufactureandbusinessentitiesinchargeof
worksafetycontrolshall,inlightofthemanufactureandbusinessoperationcharacteristicsoftheentities,carryoutroutineprofessionalinspectionandcomprehensiveinspectiononworksafety.Theyshallimmediatelygivetheopinionsforsettlementofthehiddendangersforaccidentstheydiscoverinthecourseofinspection,tracetheimprovementprocessforhiddendangersforaccidentsandrecordonfile.
Manufactureandbusinessentitiesshallsetupthe
improvementplansforthehiddendangersforaccidentsdiscoveredduringthecourseofinspection,andappointpersonsspeciallyresponsibleforcarryingouttheimprovementmeasures.

Article31Manufactureandbusinessentitiesintheindustrywith
high-leveldanger,industrywithpotentialmoredanger,andrailtrafficshall,inaccordancewiththerelatedstipulationsbythenationalgovernment,formulateemergencyrescueplans,setupemergencyrescueorganizationsandprepareemergencyrescueequipments.

Theemergencyrescueplansofmanufactureandbusinessentitiesshallmainlyincludeemergencyrescueorganizationsandtheirresponsibilities,emergencyrescuestartupprocedure,emergencymeasuresplans,trainingandregularmaneuversofemergencyrescueorganizations,storageofemergencyrescuefacilitiesandequipments,guaranteeoffunds.ChapterThree

Article32Theworksafetyadministrativeresponsibilitysystemis
carriedoutinthepeople’sgovernmentsatalllevelsandrelateddepartmentsinShanghaiCity.
Principalleadingmembersinlocalpeople’sgovernments
atthecitylevel,districtlevelandcountylevelshalltakemainresponsibilityfortheworksafetycontrolintheirrespectivedistrictandindustry.Leadingmembersinchargeofworksafetytakethecorrespondingresponsibilityinaccordancewithlaws.

Article33Localgovernmentsatdistrictandcountylevelandrelated
departmentsincitylevelshallconvenetheworksafetymeetingatleastonceperquartertoanalyzethesituationandcircumstanceonworksafetyintheirrespectivedistrictandindustry,tostudyandarrangetheprecautionmeasuresandplansformaterialandgrievousaccidents,tocoordinateandsolvetheimportantproblemsexistingintheworksafety.

Article34Localgovernmentsatcity,districtandcountylevelshall
organizetheworksafetysupervisiondepartmentsandrelateddepartmentstocarryoutinspectionontheworksafetyofmanufactureandbusinessentitiesandofmanufactureandbusinessplacesorconstructionequipments,facilitiesandworkplacesinwhichmajoraccidentsduetolackofworksafetyareliabletooccur.
Worksafetysupervisiondepartmentsandrelated
departmentsmayconductjointinspection,andregularinspectionandselectiveinspectionatanytimeontheworksafetyofmanufactureandbusinessentities.

Article41TheactsagainstthestipulationsofthisStatuteshall,ifthe
punishmentprovisionshavingbeenstipulatedinLawofPeople’sRepublicofChinaonWorkSafetyandotherrelatedlawsandadministrativeregulations,complywiththeirstipulatedpunishmentprovisions.

Article42Anymanufactureandbusinessentitythatdon’tassign
full-timepersonsinchargeofcontrolonworksafetyinaccordancewithArticle16ofthisStatuteshallbeorderedtosetitrightwithatimelimitbythedepartmentsinchargeofsupervisiononworksafety;ifitfailstodosoontheexpirationofthetimelimit,itshallbeorderedtosuspendmanufactureandbusinessoperationforrectificationandmaybefinedinaccordancewithlaws.TheamountoffineshallbecalculatedonthenumberofunassignedpersonsinchargeofcontroloverworksafetyasRMB5,000foreach.

Article43Wheretheleadingmembersinchargeofworksafetyand
personsinchargeofcontroloverworksafetyinmanufactureandbusinessentityfailtoparticipateinsafetytraining,theentityshallbeorderedtocureitrightinthetimelimitbythedepartmentsinchargeofsupervisiononworksafety;ifitfailstodosoontheexpirationofthetimelimit,itshallbefinednotelessthan5,000yuanbutnotmorethan20,000yuan.

Article44Anymanufactureandbusinessentitythatfailstoconduct,
amongitsemployees,educationandtraininginworksafetyaccordingtotheprovisionsinArticle19ofthisStatuteshallbeorderedtocorrectitrightinthetimelimitbythedepartmentsinchargeofsupervisiononworksafety;ifitfailstodosoontheexpirationofthetimelimit,itshallbeorderedtosuspendmanufactureandbusinessoperationforrectificationandmaybefinedinaccordancewithlaws.Theamountoffineshallbecalculatedonthenumberofuntrainedemployeesas500yuanforeach.

Article45Anymanufactureandbusinessentitythatfailstocarryout
dangerousoperationssuchasblastingandhoisting,orfailstoenterintoworksafetycontrolagreement,orfailsto

setupsafetyareaatsiteshallbeorderedtocorrectitbythedepartmentsinchargeofcontroloverworksafety;themanufactureandbusinessentityandauthorizedconstructormaybefinednotlessthan50,000yuanbutnotmorethan200,000yuan.

Article46Wheretheemployeesareinjuredorkilledasaresultof
accidentsduetolackofworksafety,themanufactureandbusinessentityshallcompensatefortheinjuredemployeesinaccordancewiththestipulationaboutemploymentinjuryinsurancebythenationalgovernmentandShanghaicity’sgovernment;ifacrimeisconstituted,itshallbeinvestigatedforcriminalresponsibility.

InaccordancewithLawofPeople’sRepublicofChinaonWorkSafetyandotherlawandadministrativeregulations,andinconsiderationoftheactualsituationsinShanghaiCity,thisStatuteisenactedforenhancingsupervisionoverworksafety,preventingaccidentsduetolackofworksafetyandkeepingtheiroccurrenceatalowerlevel,ensuringthesafetyofpeople’slivesandpropertyandpromotingthedevelopmentoftheeconomy.
ThisStatuteisapplicabletoworksafetyandrelatedsupervisioninentitiesthatareengagedinproductionandbusinessactivitieswithintheadministrativeareaofShanghaiCity.Whereotherwisestipulatedinrelevantlawsandadministrativeregulationsgoverningtheworksafetyonfirefighting,roadtrafficsafety,railwaytrafficsafety,waterwaytrafficsafety,civilaviation,preventionandcureoftheoccupationaldiseases,dangerouschemicalproducts,specialequipmentsandconstructionprojects,thoseprovisionsshallapply.

Worksafetyshalltakeanimplementationstructureundertheoverallleadershipofthepeople’sgovernment,exercisedwithsupervisionbythedepartmentsconcerned,infullchargebytheentities,withthesupervisionofthepeopleandtheextensivesupportfromthesociety.
ShanghaiCityshallestablishandimprovetheall-levelresponsibilitysystemforworksafety.
Worksafetyshallbepeoplefirst.Employeesshallhavetheequivalentrighttoworksafetyguarantee.
People’sgovernmentsatalllevelsshallsetupandimprovetheworksafetysupervisionsystemthatshallbetakenintotheplanningofnationaleconomyandsocialdevelopment.
ThedepartmentinchargeofsupervisionoverworksafetyinShanghaiCity(hereinafterreferredtoas“Worksafetysupervisiondepartment”shall,inaccordancewithlawsandregulations,exerciseall-roundsupervisionoverworksafetyinShanghaiCity,andinstruct,harmonizeandurgeotherdepartmentsresponsible

forthesupervisionoverworksafety(hereinafterreferredtoasdepartmentsconcernedtoperformtheirresponsibilitiesinexercisingsupervisionoverworksafety.

ThedepartmentsconcernedundertheShanghaipeople’sgovernmentatthecountylevelanddistrictlevelshall,underthedirectioninoperationoftheworksafetysupervisiondepartmentatthecitylevel,exerciseall-roundsupervisionoverworksafetywithintheirrespectiveadministrativeareas.
Thedepartmentsconcernedshall,inaccordancewithlaw,exercisesupervisionoverworksafetywithinthescopeoftheirrespectiveresponsibilities.
Withtheauthorizationfromtheworksafetysupervisiondepartmentsatcountylevelanddistrictlevel,thelocalpeople’sgovernmentsatthevillagelevelandtownshiplevelandsub-districtofficesshallcoordinatetoinspectthesituationoftheworksafetyintheproductionandbusinessentitieswithintheirrespectiveadministrativeareas,andreportanddealwiththeaccidentsduetothelackofworksafety,andmanageotherauthorizedmatters.Thelaborunionsatalllevelsshall,inaccordancewithlaw,organizetheemployeestoparticipateinthedemocraticmanagementoverworksafetyintheirentitiesandinthedemocraticsupervisionovertheactualimplementationwiththelawsandregulationsrelatedtoworksafetyintheirentities,participateintheaccidentsinvestigations,andsafeguardthelegitimaterightsandinterestsoftheemployeesinrespectofworksafety.
Newsmedia,broadcastingagencies,televisionbroadcastingandInternetcontentprovidersshallpublicizetheworksafetyknowledgethroughoutthewholesocietytocreateanatmosphereforworksafetyandtosupervisetheillegalactionsagainstworksafetybythepublicopinions.

(2Formulatingrulesandoperationregulationsforworksafety;(3Guaranteeinganecessarycapitalinputintoworksafety;

thecontrolofworksafety;
(6Principalleadingmembersandpersonsforthecontrolofwork

worksafety,employeesworkingatspecialpostsshallobtainthequalificationcertificateforworkingatspecialpoststhroughreceivingspecialtraininginsafeoperation;

entitiesshallperformtheresponsibilitiesstipulatedinLawofPeople’sRepublicofChinaonWorkSafetytostudythemattersconcerningworksafetyonaregularbasis,tosubmitreportstoworkersrepresentativemeetingandshareholdersmeetingaboutthesituationaboutworksafety,toacceptthesupervisionandinspectionfromtheworksafetysupervisiondepartmentsandotherdepartmentsconcerned,toacceptthedemocraticsupervisionfromlaborunionandemployees.Theleadingmembersinchargeofworksafetyinmanufactureandbusinessentitiesshallassisttheprincipalleadingmemberstoperformtheirresponsibilitiesonworksafety.
Theadministrativesectionsandpersonsresponsibleforwork
safetyinmanufactureandbusinessentitiesarechargedwiththefollowingresponsibilitiesforworksafety:

Manufactureandbusinessentitiesshallsetuprulesand
regulationsabouttheresponsibilitiesonwordsafety,inspection,educationandtraining,awardsandpunishment,safetycontrolonequipmentsandfacilities,distributionandadministrationonworkprotectionproducts,safetycontrolondangerousoperationandspecialoperation,settlementonaccidentsreports.
Industrieswithhigh-leveldangersuchasconstructionand
dangerousproducts(hereinafterreferredtoasindustrieswithhigh-leveldanger,industrieswithpotentiallymoredangersuchasmetalsmelt,shipbuildandrepair,electricitypowerandgoodsloadingandunloading(hereinafterreferredtoasindustrieswithpotentialmoredanger,andthemanufactureandbusinessentitieswherethenumberofemployeesexceeding300,shallsetupworksafetycommittee;themanufactureandbusinessentitieswherethenumberofemployeesbelow300maysetupworksafetycommittee.
Theworksafetycommitteeinamanufactureandbusinessentity
shallbeconstitutedbytheprincipalleadingmembers,theleadingmembersinchargeofworksafety,worksafetycontrolsectionandtheirleadingmembers,personsforworksafetycontrol,representativesfromlaborunionandemployeesofitsownentity.
Worksafetycommitteeisresponsiblefortheexaminationand
inspectionofannualplanandimplementationonworksafety,ofmaterialtechnologyprojectsonworksafety,ofkindsofinputsintoworksafetyinitsownentity,fortheunderstandingandinspectiononthematerialmattersforworksafety,fortheurgeonthemeasuresoneliminatingthehiddendangersthreateningtheworksafety.Worksafetycommitteeshallconvenemeetingsatleastonceforhalfayear.Thewrittenminutesshallbekeptforthe

meeting.

Article15Fundsforinputessentialtomeetingtheconditionsforworksafety

shallbeguaranteedbythedecision-makingsections,principalleadingmembersofmanufactureandbusinessentitiesorprivateinvestors.Thefundsforworksafetyshallbetakenintotheannualplanforproductionandbusinessandfinancialbudget.
Fundsforworksafetyshallbeinputtedintotechnologyprojects,
equipmentsandfacilitiesonworksafety,publicizing,education,training,andawardsonworksafety,workprotectionproducts,newtechniques,technologiesandmaterialsonworksafety,thesupervisiononsourcesofgrievousdanger,storageofemergencyrescuefacilitiesandmaterialsandothermattersconcerningworksafety.Fundsforworksafetyshallnotbepeculatedforotherpurposes.
Unlessotherwisestipulatedbylawsandadministrativeregulations,
manufactureandbusinessentitiesintheindustrywithhigh-leveldanger,wherethenumberofemployeesisbelow300,shallbemannedwithatleastonefull-timepersonforthecontrolofworksafety;wherethenumberexceeds300,theentitiesshallbemannedwithatleastthreefull-timepersonsforthepurpose;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleasteightfull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleastfifteenpersonsforthepurpose.
Manufactureandbusinessentitiesintheindustrywithpotential
moredanger,wherethenumberofemployeesexceeds300,theentitiesshallbemannedwithatleasttwofull-timepersonsforthecontrolofworksafety;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleastfivefull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleasttenpersonsforthepurpose.
Themanufactureandbusinessentitiesotherthantheaforesaid
entitiesstipulatedintheabovetwoparagraphs,wherethenumberofemployeesexceeds300,theentitiesshallbemannedwithatleastonefull-timepersonsforthecontrolofworksafety;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleasttwofull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleastfivepersonsforthepurpose.

Personsforcontrolofworksafetyshallparticipateinthetraining
courseonworksafetyandpasstheexaminationbeforeholdingtheposts.
Duringtheproductionandbusinessactivities,employeesshall
enjoythefollowingrights:
(1Thecollectivecontactsandlaborcontractsshallbeclearly
indicatedthetermsconcerningguaranteesforoccupationalsafety,preventionofoccupationalhazards,aswellasthepaymentofinsurancepremiumsforindustrialinjuriessufferedbyemployees;
(2Havingtheknowledgeofthedangerousfactorsexistingattheir
workplacesandposts,andoftheprecautionandexigencymeasures,obtainingtheworkprotectionproductscomplyingwiththenationalstandardsorindustrialstandards;
(3Tosuggest,criticize,informagainstandaccusetheirentitiesof
theproblemsexistinginworksafety;
(4Refusingcomplywiththedirectionsthatarecontrarytorules
andregulationsorarbitraryordersforriskyoperations.Onspottingemergencysituationsthatdirectlythreatentheirpersonalsafety,suspendingoperationorevacuatingfromtheworkplaceaftertakingpossibleemergencymeasures;
(5Demandingcompensationafterbeingdamagedbythe
accidentsduetothelackofworksafety;
(6Otherrightsstipulatedbylawsandadministrativeregulations.
Duringtheproductionandbusinessactivities,employeesshallperformthefollowingduties:
(1Strictlyabidingbyworksafetyrulesandregulationsand
operationinstructionsoftheentitiestheywork;(2Receivingeducationandtraininginworksafety;
(3Reportingthehiddendangersthatmayleadtoaccidentsand

complywiththerelatedregulationsbythenationalgovernmentandShanghaigovernment.Theexpensesshallbebornebythemanufactureandbusinessentities.
Manufactureandbusinessentitiesmayauthorizetheagencieson
worksafetytrainingserviceorrelatedindustryassociationstomakearrangementfortheeducationandtraininginworksafety.
Thecontentsfortheeducationandtraininginworksafetyshall
includethelaws,administrativeregulationsandrulesonworksafety,basicskillsonsafetyoperationandbasicknowledgeonsafetytechnology,dangerousfactorsexistinginworkplacesandposts,precautionmeasuresandaccidentsemergencymeasures,thefunctionsanduseofworkprotectionproducts,andotherknowledgeonworksafetyneededtounderstand.

Thecontentsforeducationandtraininginworksafetyshallbewrittenintotherecordcardforworksafetybytheemployees.Therecordcardshallbesignedbytheexaminerandemployeehimself.

setupbythemanufactureandbusinessentitiesforthelarge-scalepublicactivitiesshallbeinspectedbytheprofessionallyrecognizedinspectioninstitutesforqualification.
Withthesubmissionofthedesignsofthesafetyfacilitiesof
constructionprojectsforthemanufactureandstorageofdangerousproductstoworksafetysupervisiondepartmentsandrelateddepartmentsforexamination,thesafetyconditionassessmentandreasoningreportsissuedbytheagencieswithprofessionalqualificationonworksafetyassessmentshallbesubmittedaswell.Theexaminationdepartmentshallberesponsiblefortheresultofexamination.
Beforethecompletedconstructionprojectsforthemanufacture
andstorageofdangerousproductsareputintooperationoruse,thesafetyfacilitiesshallundergocheckforacceptancebytheworksafetysupervisiondepartmentsandrelateddepartments.Thesaidprojectsshallonlybeputintooperationoruseafterthefacilitiesarecheckedandaccepted.
Manufactureandbusinessentitiesforthemanufacture,storage
anduseofvirulentchemicalproductsshall,withthetermstipulatedbythenationalgovernment,authorizetheagencieswithprofessionalqualificationonworksafetyassessmenttoevaluatethesafetyoftheequipmentsformanufactureandstorage,andissuedthesafetyassessmentreport.
Thesafetyassessmentreportshallprovidecorrespondingplanon
safetyreformmeasuresaimingattherealdangerandproblemsexistinginthemanufactureandstorageequipments.
Manufactureandbusinessentitiesshallsubmitthesafety
assessmentreporttotheworksafetysupervisiondepartmentsfor

Manufactureandbusinessentitiesshallreportatleastoncefora
half-yeartotheworksafetysupervisiondepartmentsandpublicsafetyauthoritiesabouttheimplementationprocedureofthesupervisiononthesourcesofgrievousdanger.
Whencarryingoutdangerousoperationssuchasblastingand
hoistingoflarge-sizedfacilities(components,manufactureandbusinessentitiesshallsendpersontothesitesspeciallyassignedtogiveoveralldirection.Thesitesshallbeinspectedandsupervisedbythespeciallyassignedpersonsforworksafetysupervision.Suchdangerousoperationsshallbecarriedoutbytheentitieswithprofessionalqualification.Ifauthorizingotherentitieswithprofessionalqualificationforconstruction,manufactureandbusinessentitiesshallenterintotheworksafetycontrolagreementwiththeconstructor.Worksafetycontrolagreementshallspecifyrespectiveresponsibilitiesonworksafetyoftheparties.
Manufactureandbusinessentitiesorauthorizedconstructorsshall
maketheconstructionplanandworksafetyprecautionmeasuresforthedangerousoperationsofblastingandhoistingoflarge-sizedfacilities(components,andsetupthesafetyareainthesites.
Whencarryingoutthedangerousoperationssuchasblastingand

hoistingoflarge-sizedfacilities(components,employeesshallobservetheoveralldirectionsandcontrolatsites,strictlycomplywiththeoperationplan,operationrulesandproceduresandworksafetyprecautionmeasures.

Article28Ifthepremisesandworkplacesarerentedouttootherentitiesfor

Lessorsshallexaminethemanufactureandbusinessscopeofthe
lessee;conductoverallcoordinationandmanagementamongmorethanonelesseewithinoneworkplaceinrespectofworksafety.Whendiscoveringtheillegalactivitiesonworksafetybythelessees,manufactureandbusinessentitiesshallpreventsuchactivitieswithoutdelayandnotifythelocalworksafetysupervisiondepartmentsandrelateddepartments.
Lesseesshallstrictlycomplywiththelawsandadministrative
regulationsconcerningworksafetyandpossessthenecessaryqualifications,observetheoverallcoordinationandmanagementinrespectofworksafetybylessors.Whenaccidentsduetoneglectofworksafetyoccur,lesseesshalltruthfullyinformthelocalworksafetysupervisiondepartmentsandrelateddepartments.
Manufactureandbusinessentitiesshallprovidetheiremployees
withworkprotectionproductsthatmeasureuptonationalstandardsorindustrialspecifications,andtheyshallgiveinstructiontotheiremployeesandcheckthattheemployeeswearorusetheseproductscorrectlyinaccordancewiththerulesforuse.Manufactureandbusinessentitiesshallnotsubstitutecashorotherarticlesfortheworkprotectionproducts.Whenpurchasingtheworkprotectionproducts,manufactureandbusinessentitiesshallrequiretheproductexaminationcertificatefortherecordkeptonfile.
Personsofmanufactureandbusinessentitiesinchargeofwork
safetycontrolshall,inlightofthemanufactureandbusinessoperationcharacteristicsoftheentities,carryoutroutineprofessionalinspectionandcomprehensiveinspectiononworksafety.Theyshallimmediatelygivetheopinionsforsettlementofthehiddendangersforaccidentstheydiscoverinthecourseofinspection,tracetheimprovementprocessforhiddendangersfor

Manufactureandbusinessentitiesshallsetuptheimprovementplansforthehiddendangersforaccidentsdiscoveredduringthecourseofinspection,andappointpersonsspeciallyresponsibleforcarryingouttheimprovementmeasures.

Theworksafetyadministrativeresponsibilitysystemiscarriedout
inthepeople’sgovernmentsatalllevelsandrelateddepartmentsinShanghaiCity.
Principalleadingmembersinlocalpeople’sgovernmentsatthe
citylevel,districtlevelandcountylevelshalltakemainresponsibilityfortheworksafetycontrolintheirrespectivedistrictandindustry.Leadingmembersinchargeofworksafetytakethecorrespondingresponsibilityinaccordancewithlaws.

Worksafetysupervisiondepartmentsatcitylevelshallinformthe
accidentsduetothelackofworksafetyregularlytolocalgovernmentsatdistrictandcountylevelandrelateddepartments.Itisshallbeinformedwithoutdelayonmaterialandgrievousaccidentshappenedduetothelackofworksafetyandtypicalaccidentswithbigsocialinfluenceandseverenature.
Worksafetysupervisiondepartmentsatcitylevelshallpublicize
thecurrentsituationonworksafetyandmaterialaccidentsduetothelackofworksafetyregularlytothesociety.Itisshallbepublicizedwithoutdelayonmaterialandgrievousaccidentshappenedduetothelackofworksafetyandtypicalaccidentswithbigsocialinfluenceandseverenature.
Shanghaicityshallsetupsupervisionsystemonsourcesof
grievousdangertomaketwo-level(citylevelanddistrict,countylevelsupervisiononsourcesofgrievousdanger.
Worksafetysupervisiondepartmentsshallmakeregistrationon
sourcesofgrievousdangerwithotherdepartmentstoinspectthesafetyassessmentsituationonsourcesofgrievousdanger.
Localgovernmentsatcity,districtandcountylevelshall,in

directionsystem,identifyingemergencyrescueresponsibilitiesforthedepartmentsconcerned,establishingemergencyrescuegroup,confirmingtheexpertsforemergencyrescuetechniques,buildingdatabasefordealingequipmentsonemergency,ensurethe

Allentitiesandindividualsshallhavetherighttoreportorcomplain
abouthiddendangersthatmayleadtoaccidentsandpracticesviolatingworksafetylawstothedepartmentsinchargeofsupervisionoverworksafety.Theworksafetysupervisiondepartmentsordepartmentsconcernedshallgiveawardstopeoplehavedonemeritoriousservicesinreportingtheaforesaidmatters.
Departmentsinchargeofsupervisionoverworksafetyand
departmentsconcernedshallkeepconfidentialtheinformationaboutthecomplainingpeople.
ManufactureandbusinessentitiesisencouragedinShanghaicity
toapplyforlicenseoncareerhealthsafetycontrolsystemtoimprovetheirworksafetyconditionsandworksafetymanagementlevel.
ChapterFourLegalResponsibility
TheactsagainstthestipulationsofthisStatuteshall,ifthe
punishmentprovisionshavingbeenstipulatedinLawofPeople’sRepublicofChinaonWorkSafetyandotherrelatedlawsandadministrativeregulations,complywiththeirstipulatedpunishmentprovisions.
Anymanufactureandbusinessentitythatdon’tassignfull-time
personsinchargeofcontrolonworksafetyinaccordancewithArticle16ofthisStatuteshallbeorderedtosetitrightwithatimelimitbythedepartmentsinchargeofsupervisiononworksafety;ifitfailstodosoontheexpirationofthetimelimit,itshallbeorderedtosuspendmanufactureandbusinessoperationforrectificationandmaybefinedinaccordancewithlaws.Theamountoffineshallbecalculatedonthenumberofunassignedpersonsin

Anymanufactureandbusinessentitythatfailstoconduct,among
itsemployees,educationandtraininginworksafetyaccordingtotheprovisionsinArticle19ofthisStatuteshallbeorderedtocorrectitrightinthetimelimitbythedepartmentsinchargeofsupervisiononworksafety;ifitfailstodosoontheexpirationofthetimelimit,itshallbeorderedtosuspendmanufactureandbusinessoperationforrectificationandmaybefinedinaccordancewithlaws.Theamountoffineshallbecalculatedonthenumberofuntrainedemployeesas500yuanforeach.
Anymanufactureandbusinessentitythatfailstocarryout
dangerousoperationssuchasblastingandhoisting,orfailstoenterintoworksafetycontrolagreement,orfailstosetupsafetyareaatsiteshallbeorderedtocorrectitbythedepartmentsinchargeofcontroloverworksafety;themanufactureandbusinessentityandauthorizedconstructormaybefinednotlessthan50,000yuanbutnotmorethan200,000yuan.
Wheretheemployeesareinjuredorkilledasaresultofaccidents
duetolackofworksafety,themanufactureandbusinessentityshallcompensatefortheinjuredemployeesinaccordancewiththestipulationaboutemploymentinjuryinsurancebythenationalgovernmentandShanghaicity’sgovernment;ifacrimeisconstituted,itshallbeinvestigatedforcriminalresponsibility.
Ifanymanufactureandbusinessentityoranypartyisnotsatisfied
withthepracticaladministrativebehaviorsbythedepartmentsinchargeofsupervisionoverworksafetyanddepartmentsconcerned,itmay,inaccordancewiththeprovisionsofAdministrativeReconsiderationLawofPeople’sRepublicofChinaorofAdministrativeLitigationLawofPeople’sRepublicofChina,applyforreconsiderationorlitigation.
Ifupontheexpirationofthetimeperiod,themanufactureand

businessentityorthepartyhasnotappliedforreconsiderationonthepracticaladministrativebehavior,norbroughtasuitbeforeapeople’scourt,norcompliedwiththepracticaladministrativebehavior,thedepartmentsinchargeofsupervisionoverworksafetyanddepartmentsconcernedmayapplytothepeople’scourtforcompulsoryexecution.

Article48Ifanyprincipalleadingmemberandotherleadingmemberofany


Article49departmentinchargeofsupervisionoverworksafety,orthedepartmentconcernedfailstoconducthisresponsibilities,abuseshispower,commitsirregularitiesforthebenefitofhisrelativesorfriends,ordisclosethecomplainingpersons,heshallbegivenadministrativesanctionsinaccordancewithlawbyhisentityorsuperiorcompetentauthority;ifacrimeisconstituted,heshallbeinvestigatedforcriminalresponsibilityinaccordancewithlaw.

ThisStatuteemphasizesontheprotectionofthelivesandhealthoftheemployeesduringthemanufactureandbusinessactivities,suchasthattheemployeeshavetherighttorequesttounderstandthedangerousfactorsandprecautionmeasuresintheirposts;havetorighttorefusetocomplywiththedirectionsthatarecontrarytorulesandregulationsorarbitraryordersforriskyoperations;havetherighttoreceiveeducationandtrainingonworksafety.ThisStatutealsoidentifyspecificallythatthedepartmentsinchargeofsupervisiononworksafetyshallpreventthemanufactureandbusinessentitiesfrominfringingthelegalrightsonworksafetyoftheemployeeswithoutdelay.

ThisStatutestrengthensontheworksafetyguaranteeofmanufactureandbusinessentities,andstandardizetheworksafetyconditionsandtheworksafetyresponsibilitysystemamongtheprincipalleadingmembersofmanufactureandbusinessentities.ThisStatuteensurethatIndustrieswithhigh-leveldanger,industrieswithpotentiallymoredanger,andthemanufactureandbusinessentitieswherethenumberofemployeesexceeding300,shallsetupworksafetycommittee;industrywithhigh-leveldanger,wherethenumberofemployeesisbelow300,shallbemannedwithatleastonefull-timepersonforthecontrolofworksafety;wherethenumberexceeds300,theentitiesshallbemannedwithatleastthreefull-timepersonsforthepurpose;wherethenumberexceeds1,000,theentitiesshallbemannedwithatleasteightfull-timepersonsforthepurpose;wherethenumberexceeds5,000,theentitiesshallbemannedwithatleastfifteenpersonsforthepurpose;themanufactureandbusinessentitiesshallsetupandimproveallkindsofrulesandregulationstofocusontheadministrativeprincipleof“PrecautionCrucial”topreventtheaccidentsfromhappening.

ThisStatutefurtherstrengthensonthesupervisionoverworksafetybythegovernmentandidentifiesspecificallythatthedepartmentinchargeofsupervisionoverworksafetyinlocalgovernmentatalllevelsshallexerciseall-roundsupervisionoverworksafetyandinstruct,harmonizeandurgeotherdepartmentsresponsibleforthesupervisionoverworksafetytoperformtheirresponsibilitiesinexercisingsupervisionoverworksafety.
