advertisingorfromdirectselling,orfromsomecombinationofboth.Theirknowledgeofourintimatelivesdoesntwaittwocenturiesormoreuntilweredead.Theygetitlive,inrealtime.Sometimestheyknowourmindsbeforeweknowthemourselves.Itsasituationquiteunprecedentedinhistory.
TheEuropeancommissionmaybeabouttolevythebiggestfineinitshistoryonGoogleforanti-competitivebehaviourpotentiallymorethan€1bn.Thiscase,fiveyearsinthemaking,isthelatest,andperhapsthelargest,battleinthestruggletoestablishdemocraticcontroloverthegiantsofthedigitaleconomy.IntheUS,thegovernmenthasbeencapturedbythecorporations,andinChinauniversalsurveillanceisopenlyconvertedtoameansofgovernmentcontrol.OnlytheEUattemptstobalancethesepowerstothebenefitoftheordinarycitizen.
ThepowerandambitionofthesecompaniesisastonishingAmazonhasjustannouncedthepurchaseoftheupmarketgrocerychainWholeFoodsfor$13.5bn,buttwoyearsagoFacebookpaidevenmorethanthattoacquiretheWhatsAppmessagingservice,whichdoesnthaveanyphysicalproductatall.WhatWhatsAppofferedFacebookwasanintricateandfinelydetailedtraceryofitsusersfriendshipsandsociallives.FacebookpromisedtheEuropeancommissionthenthatitwouldnotlinkphonenumberstoFacebookidentities,butitbrokethepromisealmostassoonasthedealwentthrough.Evenwithoutknowingwhatwasinthemessages,theknowledgeofwhosentthemandtowhomwasenormouslyrevealingandstillcouldbe.Whatpoliticaljournalist,whatpartywhip,wouldnotwanttoknowthemakeupoftheWhatsAppgroupsinwhichTheresaMaysenemiesarecurrentlyplotting?ItmaybethatthevaluetoAmazonofWholeFoodsisnotsomuchthe460shopsitowns,orthedistributionnetwork,buttherecordsofwhichcustomershavepurchasedwhat.

Competitionlawappearstobetheonlywaytoaddresstheseimbalancesofpower.Butitisclumsy.Foronething,itisveryslowcomparedtothepaceofchangewithinthedigitaleconomy.Bythetimeaproblemhasbeenaddressedandremedieditmayhavevanishedinthemarketplace,tobereplacedbynewabusesofpower.Butthereisadeeperconceptualproblem,too.Competitionlawaspresentlyinterpreteddealswithfinancialdisadvantagetoconsumersandthisisnotobviouswhentheusersoftheseservicesdontpayforthem.Theusersoftheirservicesarenottheircustomers.ThatwouldbethepeoplewhobuyadvertisingfromthemandFacebookandGoogleoperateavirtualduopolyindigitaladvertisingtothedetrimentofallothermediaandentertainmentcompanies.
Theproducttheyresellingisdata,andwe,theusers,convertourlivestodataforthebenefitofthedigitalgiants.Justassomeantsfarmaphidsforthehoneydewthatoozesfromthemwhentheyfeed,soGooglefarmsusforthedatathatourdigitallivesexude.Antskeeppredatoryinsectsawayfromwheretheiraphidsfeed;Gmailkeepsthespammersoutofourinboxes.Itdoesntfeellikeahumanordemocraticrelationship,evenifbothsidesbenefit.
